Introduction and Acceptance of Terms

These Terms of Use ("Terms") govern access to and use of the Local Listings platform ("Platform", "we", "us", "our"). The Platform provides an online venue through which users may publish and view classified advertisements. By accessing, browsing, registering for, or otherwise using the Platform, you acknowledge that you have read, understood, and agree to be legally bound by these Terms. If you do not agree to these Terms, you must immediately discontinue use of the Platform. These Terms constitute a binding agreement between you and the operator of Local Listings.

Eligibility and Legal Capacity

Use of the Platform is limited to individuals who are at least eighteen (18) years of age and who possess the legal capacity to enter into binding agreements under applicable law. By using the Platform, you represent and warrant that you satisfy these requirements and that all information provided to us is accurate, complete, and not misleading. We reserve the right to require proof of age or identity at any time.

Account Registration and Security

Certain features of the Platform require account registration and email verification. You are solely responsible for maintaining the confidentiality of your account credentials and for all activity occurring under your account. You agree to notify us promptly of any unauthorised access or use. We may suspend, restrict, or terminate accounts where we reasonably suspect breach of these Terms, unlawful conduct, or security risk.

Identity Verification and Compliance

We may, at our discretion, require users to provide identity verification, contact details, or other documentation as a condition of continued access to certain features. Failure to provide requested information may result in suspension or termination of access. We reserve the right to cooperate with law enforcement and regulatory authorities where required by applicable law.

Nature of the Platform

Local Listings operates solely as an online publishing venue for classified advertisements. We are not a party to transactions between users and do not act as agent, broker, intermediary, distributor, or representative of any user. We do not process payments, arrange delivery, or verify the legality, quality, safety, or accuracy of listings. All transactions are conducted exclusively between users at their own risk.

Advertisements and Content Moderation

All advertisements are subject to administrative review prior to publication. We reserve the unrestricted right to refuse, edit, remove, or disable any listing at our sole discretion and without obligation to provide justification. Listings expire thirty (30) days following initial approval unless otherwise specified. Editing a listing does not extend its expiry period. Listing features and fees may be modified at any time, with applicable pricing displayed prior to publication.

User Content and Licence Grant

Users are solely responsible for all content submitted to the Platform. You represent and warrant that you possess all necessary rights to publish such content and that it does not violate any law or third-party rights. By submitting content, you grant us a non-exclusive, worldwide, royalty-free licence to host, display, reproduce, and distribute such content solely for the operation and promotion of the Platform. We do not claim ownership of user content.

Prohibited Conduct

You agree not to use the Platform for any unlawful, fraudulent, deceptive, abusive, or infringing purpose. Prohibited conduct includes, without limitation, listing stolen or counterfeit goods, illegal substances, unlicensed regulated items, fraudulent schemes, harassment, hate speech, or intellectual property violations. We may remove content or terminate access without notice where violations are identified.

Platform Intellectual Property

All software, design elements, branding, trademarks, database structure, and content created by or for the Platform are the exclusive property of Local Listings and are protected by applicable intellectual property laws. No licence is granted except as expressly stated. Users may not reproduce, copy, modify, distribute, or exploit any part of the Platform without prior written consent.

Indemnification

You agree to indemnify, defend, and hold harmless Local Listings, its owners, officers, and affiliates from and against any claims, demands, losses, damages, liabilities, costs, and expenses, including reasonable legal fees, arising out of or related to your use of the Platform, your submitted content, your violation of these Terms, or any dispute between you and another user.

Limitation of Liability

The Platform is provided on an "as is" and "as available" basis without warranties of any kind. To the fullest extent permitted by law, we disclaim all express and implied warranties. We shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from use of the Platform. Our total aggregate liability shall not exceed the greater of the amount paid by you to the Platform in the preceding twelve (12) months or TT$100.

Force Majeure

We shall not be liable for any delay or failure to perform resulting from causes beyond our reasonable control, including but not limited to natural disasters, power outages, internet disruptions, governmental actions, or acts of civil unrest.

Termination

We reserve the right to suspend or permanently terminate access to the Platform at our sole discretion, with or without notice, for any breach of these Terms or for operational, legal, or security reasons.

Amendments

We may amend these Terms at any time by publishing an updated version on the Platform. Continued use following publication constitutes acceptance of the revised Terms.

Governing Law and Jurisdiction

These Terms are governed by the laws of Trinidad and Tobago. Any dispute arising out of or relating to these Terms or use of the Platform shall be subject to the exclusive jurisdiction of the courts of Trinidad and Tobago.

Severability and Entire Agreement

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. These Terms constitute the entire agreement between you and Local Listings concerning use of the Platform and supersede all prior understandings.
